- HEAVY PENALTY FOR FOLLY.
Consequent upon his failing to appear,. when out on bail, at the Borough Unirt on Monday morning to answer a charge of drunk and disorderly a summons had been issued against Ernest Halstead. fitter, of Halifax. and he was now called upon to show cause why he should not forfeit his recognizance deposited in the hands of the police at the time he was bailed out.
Supt. Brown stated that the defendant was very drunk and disorderly on the night of the 6th. He was taken to the Police Station. and later bailed out. He was told to appear at the Court on the following Monday forenoon but failed to turn up.
P.C. Hagyard deposed that on Saturday evening, the 6th, he was on duty at the George Corner. when he saw defendant in a drunken condition. He had been fighting. Witness requested defendant to go away several times, but he refused, and then locked him up.
Defendant: Did not I ask you to put me to any physical test?
Witness: No.
Did not I ask you to fetch a dootor?-No.
Did not I go to the Police Station quietly? —No. you did not. You were shouting and swearing.
Inspector Taylor substantiated the previous witness's evidence. Defendant was very drunk when he entered the Police Station, and his face, was covered with blood. Shortly after his arrest defendant said he wished to see a docto. Witness told him he would have to pay for him. Then he asked to be let out, and witness informing him that he would be released at 11 o'clock, he said that would be all right.
In reply to defendant the Inspector stated that defendant said, when he understood that he would have to pay for the attendance of a doctor, that he did not want one.
Halstead admitted being "fresh," but he was not drunk. When he was taken to the lock-up he asked them to put him to any physical test as to whether or no he was drunk. They started trying to make fun of him, telling him to "stand on his head."
Examined by Supt. Brown, defendant said he thought by his non-appearance the sovereign he had deposited would be taken in default.
Is this your first experience of s Police Court?—No, sir. But you have no right to bring that up before these gentlemen. You are exceeding your duty.
In respect to the charge of drunkenness, defendant was ordered to pay 9s. 6d. costs and 10s. fine, or seven days' imprisonment.
With regard to the other summons, defendant pleaded that he did not turn up at the Court on Monday on account of ignorance.
He was ordered to forfeit £1 and pay the costs; amounting to 8s. 6d.
