    • A Land Dispute
      Hartley Halstead, of Nutsbaw Farm, brought an action against the Executors of Colonel to recover tho sum of £12 16s. 8d. —Mr. Bulcock was for the plaintiff and Mr. Southern for the defendants.—The action arose out of the use of land in the occupation of the plaintiif for the tramway belonging to the defendants, and the defendants had paid £7 5s. into court, and the point in dispute was the amount to be paid annually for damages to the land traversed by the tramway. Plaintiff claimed £4 3s. 4d. .'per annum, and defendants proffered 30a. per annum. Two years' use tba land were in dispute, and that made the difference (£5 11s 8d.) between tho amount originally claimed and the amount paid into court.—Mr. Bulcock said that the defendants had paid this annual sum of £4 3s. 4d. damages from 1876 to 1889. From 1876 to ISS6 the plaintiff was also tenant of the adjoining farm. Higher Nutshaw Farm, and during that period received as additional damages £5 2s. 4d. per annum. Mr. Southern explained that the defendants were liable the payment £5 per customary acre under the. terms of a lease (dated July 30th, 1853) from the plaintiff's landlord to the defendants' in title.— Mr. Bulcock said the plaintiff did not know of the existence that leaae, but his claim was the rate of £5 per customary acre.—Mr. Southern said there was an arbitration clause the lease.— His Honour then said he would assess the damages per customary acre and decide the case upon the evidence given as to the amount of land damaged.—Plaintiff, called, said that land had been given up by the defendants. —Answering Mr. Southern, the witness said there were some disused pits near tho tramway.—Mr. Southern, for the defence, put in the lease alluded to, but Mr. Bulcock denied that his client was bound to recognise rights acquired by the defendants from his landlord. —His Honour thought otherwise.—Mr F. J. Grant, agent for the defendants, gave evidence that the Exors. were still in possession of the Hapton Valley pits under the renewal of the lease.—Matthew Birkett, surveyor, deposed that he and Mr. Storey (agent for the plaintiff's landlord), had measured the land in the plaintiff's occupation for purpose of assessing the damages under the lease. Mr. Riley and Mr. Chichester, assistants Mr. Storey, were also present. They agreed upon a mean width of the tramway of 3 1/2 yarda. Plaintiff got a benefit by that general average. The tramway was 670 yards long upon tho land in plaintiff's occupation. —By His Honour: 2,345 yards (670 by 3 1/2) at £5 per customary acre would be £1 10s —Continuing, the witness said he had again measured the land found the exact quantity to 2,010 square yards. At £5 per customary acre that would be about 25s. —His Honour thought the sumpaid into Court sufficient and gave judgment for the defendants
