    • CRIPPLED EX-SOLDIER'S CASE
      DESERTION CHARGE DISMISSED
      An soldier with a disabled left hand figured as defendant in a wife desertion case which the Borough Magistrates were called upon to decide at the Police Court on Wednesday He was John Halstead (28) residing in Cuerdale Street, Harle Syke. His wife, Florrie, alleged that he deserted her on his discharge from hospital at Liverpool in September last. Mr. W. Mossop appeared for complainant, and Mr. J C. Waddington defended.
      According to Mr Mossop's statement to the Bench, the parties were married on March 19th, 1912, at Ebenezer Chapel, and there was one child, a boy now six years old. Defendant went into the Army 1915, when the couple were livng in Ardwick Street. He was finally discharged from hospital on November 4th last year, but be did not resume cohabitation with his wife, and instead of going home to her went to his mother's house. There was something alleged against her, but she said it was absolutely without foundation. Since that time he had sent her various sums —17s 6d. per week for three weeks, then dropped it to 10s., which sent for six weeks, and later lowered again 7s. On the 28th January, however, he stopped the payments, and had sent her nothing since. The wife had written three times to him since his discharge from hospital asking him, if was not prepared to return to her, what he was going to do.
      Complainant, who lives at 53, Grey Street, Burnley, bore out her solicitor's statement.—ln cross-examination by Mr. Waddington, she denied that she "had had a good time" whilst her husband was away, that had associated with men.
      In reply to Mr Waddington admitted writing a number of abusive letters to her whilst he was in hospital, in one of which she said she had finished with him. She now said she also wrote the letters in a temper and did not mean what she wrote. They were in reply to letters he had written to her, which had been destroyed.
      Re-examined by Mr Mossop, she denied all suggestions made by Mr Waddington as to her conduct with other men.
      Mr Waddington submitted to the bench that there was no case of desertion proved, and even if there was desertion it was not without "reasonable and probable cause".
      The bench said there would be no order, and the case would be dismissed.
