  	"Howard Price first indentified Benjamin H. Halsted as our ancestor out of Georgia. He also made pencil notes that Benjamin's spouse could be Dubois or Hodges. I have decided to go with Hodges as there were Hodges that settled at Brooklyn, Alabama the same time (about 1825) that Benjamin Hawkins settled at Brooklyn.   "Date of birth is taken from age listed in U. S. Census for 1850 and 1860 and 1870. Epthus Halsted's first name is spelled many different ways in the census Records. 1850 - Epephras; 1860 - Epherus; 1870 - Epthus. I have decided to go with Epthus. The middle initial of "F" comes from the probate court records of Grimes County in 1858. There was a probate court case in Grimes County involving Epthus and a slave he owned, starting on 30 June 1858 and finally being resolved in January 1859. In June 1858 Matt Shannon, Petitioner, filed a request that he be appointed guardian of the estate of E. F. Halstead, a minor under the age of 14. Since no one appeared to contest the petition the court made the appointment. (We do not know where Epthus' parents, brothers or sister was when this appointment was made.) Later, on 2 August 1858, Matt Shannon petitioned the court that he be allowed to sell subject Negro boy "Berry" belonging to E. F. Halstead, his ward, for expenses incurred in obtaining said Negro as being the only property belong to E. F. Halsted. The court ordered that notice of the petition be published in the newspaper for the next four weeks for any interested persons to appear before the court. When the court next met to hear the case, B. H. Halsted, the father of E. F. Halsted appeared and filed a protest against the sale of the Negro slave. The protest was approved and the petition by Matt Shannon was dismissed. When the Court next met the heard and approved a petition by B. H. Halsted to be appointed guardian of E. F. Halsted, a minor under 14 years of age. But the court ordered that the Negro boy Berry remain in the possession of Matt Shannon until said Shannon was paid certain costs he had incurred. During the January 1959 Term of the Court, B. H. Halstead appeared along with his friend, Dr. James Mitchell, who paid Matt Shannon for his incurred costs, and the Court ordered Matt Shannon to release and deliver the said Negro, Barry, to Mitchell. Mitchell was to hold the slave pending further orders of the court. Grimes County, Texas Probate Court Records Vol. 3-1 Pages 357, 366, 375, 380, 381, 394, 395 and 437. I have not been able to find any records of where Epthus' father, mother or other adult family members could have been when this case was being pursued by Matt Shannon through the court. All of them (except Elizabeth J.) were still together as a family at the community of Retreat, Grimes County, Texas at the time of the 1860 U. S. Census. After appearing in the Washington County, Texas 1870 U. S. U. S. Census as a 26 year old farmer in the household of his elder brother, Benjamin Robert Halsted, no further records or data have been discovered for Epthus F. Halsted." Benjamin Donald Halsted
