Thomas, who had big stick in his hand and said " Nellie slipped in water and I going to get her out.” Witness went to the pond and saw the child floating in the water, about three yards from the edge. Her husband came running down the road as she was about jump in and he entered the water and got the child out —Richard Halstead, father of deceased, said on the previous afternoon his son. Tom, came to him and told him Nellie had fallen into the pond. He immediately ran to the pond and got the child out. He laid her on the grass and applied artificial respiration until S.L.
